- TERMS OF TRADING
All goods remain property of Anatech until the total invoice is paid in full.
- All prices quoted in Canadian dollars, FOB Richmond, B.C (unless otherwise stated).
- All prices are subject to applicable GST/HST
- Minimum order – free ground shipping for orders over $600
- We cover freight for all base charges. This does not include any extra surcharges (i.e. oversize items, residential fees, rural surcharges or unadvised address change charges)
- A service charge of $25.00 will be levied on all NSF cheques.
- Net 30 terms will be given upon completion and approval of credit application
- VISA / MASTERCARD / CHEQUE / EFT all accepted
- Anatech Inc. maintains the right to change terms or hold any orders on delinquent overdue accounts.
- PRICING
Anatech endeavors to provide 30 days notice of any price increase. However, in the event of errors and omissions, all prices are subject to change by Anatech without notice.
- MANNER OF SALE
Retailer shall sell the Products only as set forth herein.
- Anatech will advise Retailers of any no-sell lists, should any vendor have territorial limitations in place. for specific imported products.
- Unless an Anatech Product needs to fitted by a professional, i.e. in the case of a hinged knee brace, the Retailer is permitted to market for sale or sell Anatech Products through websites owned or operated by Retailer. This is under the provision that such websites identify Retailer’s full legal name, mailing address, telephone number and email address.
- Sales in violation of the Terms are strictly prohibited and may result in Anatech’s termination of Retailer’s account.
- DAMAGES & SHORTAGES
All claims for lost shipments, damages, or shortages must be made within 10 business days from the date of invoice. Any errors on shipments should be reported within 10 days of receipt. Please contact head office with any discrepancies.
Anatech will process and file claims against the transportation companies for loss or damages to our shipments provided the Retailer:
- Secures the carrier’s notation on the delivery receipt and reports to us within 10 business days all loss or damage evident at the time of delivery; and
- Reports any concealed loss or damage to the carrier, obtaining their inspection within 10 business days after receipt of the shipment and furnishes us with the carrier’s inspection report. In cases where damage, shortage or loss is not due to transportation causes, and when Retailers report to us promptly any such damage, shortage or loss, we will adjust such claims as are directly traceable to any fault or negligence on Anatech’s part. Anatech will not be liable for delays in delivery or Product availability due to customs, shipping, or natural disasters
- Exception: Retailer requests alternate collect shipping method, thus retailer will need to contact transport company for loss or damage claim.
- WARRANTY & RETURN POLICY
Unless otherwise noted on specific products, Anatech warrants that all products shall be free from defects in materials and workmanship for a period of 90 days. Product durability will vary with usage and care. Any warranty is voided if wear or usage instructions are disregarded and if care instructions are not followed.
All returns are subject to inspection and verification by Anatech Inc. to determine eligibility for a full or partial refund. Items deemed non-returnable shall be returned to the customer at their expense. Please follow the Return Merchandise Authorization procedure on RMA form.
Returned goods not under warranty will only be accepted under the following conditions:
- Goods returned without prior authorization will not be accepted.
- Returns must be shipped prepaid to Anatech and must have am RMA # on the shipping label. A reason for return along with the invoice number and date of purchase must be included.
- Goods returned for warranty must be in a clean and hygienic condition. If it is not clean it will be returned to you.
- Upon examination of all returned goods, Anatech will replace or credit any items that fall under our warranty policy at our discretion. Our return to you will be prepaid via our courier. If you should prefer another courier, the items will be shipped freight collect.
- Goods returned for reasons other than warranty must not be worn or used.
- A restocking fee may be charged for any items returned for reasons other than warranty; the percentage is dependent on the situation and will be on a case by case basis. Product must be in saleable condition to be accepted
- DISCLAIMER
- Anatech Inc. holds no claim that any product we sell will heal a condition or fully eliminate pain. Always consult your health care provider before purchasing any medical equipment or supplies.
- Anatech Inc. does not provide medical advice or diagnosis. We will gladly provide complete and accurate descriptions but cannot determine the appropriateness of a particular product for a buyer.
- Anatech Inc. does not take any kind of medical insurance for payment. Our company accepts Visa and MasterCard
- While Anatech strives to be error-free, there may be typographical errors, inaccuracies or omissions in any part of this website, artist and product descriptions, pricing and availability. We reserve the right to correct or update any error at any time without notice, including after you have submitted your order. We do our best to depict product colors accurately, but please be aware that colors may appear differently depending on the monitor on digital device. Therefore, we cannot guarantee the accuracy of colors shown in the photos.
- PRODUCT CARE & QUALITY CONTROL
Retailer shall care for the Products as set forth herein.
- Product Inspection. Retailer shall inspect the Products upon receipt and during storage for damage, defects, or other non-conformance (collectively, “Defects”). If any Defects are identified, Retailer must not offer the Product for sale and must promptly report the Defects to Anatech.
- Product Storage and Handling. Retailer shall exercise due care in storing and handling the Products, store the Products in a cool, dry place, away from direct sunlight, extreme heat, and dampness, and in accordance with any additional storage guidelines specified by the original manufacturer.
- Recalls and Consumer Safety. To ensure the safety and well-being of the end-users of the Products, Retailer shall cooperate with Anatech with respect to any Product recall or other consumer safety information dissemination effort.
- Alterations Prohibited. Unless a modification has been previously discussed with Anatech, Retailer shall sell Anatech Products as is, in their original packaging. They shall not sell or label Anatech Products as “used”, “open box” or any other similar descriptors. Relabeling, repackaging, misbranding, adulterating, and other alterations are not permitted.
- Removing, translating, or modifying the contents of any label or literature accompanying the Products is prohibited. Retailer shall not advertise, market, display, or demonstrate non-Anatech products together with the Products in a manner that would create the impression that the non-Anatech products are made by, endorsed by, or associated with Anatech.
- Customer Service & Product Representations. Retailer and Retailer’s sales personnel shall familiarize themselves with the features of all Products marketed for sale and must obtain sufficient Product knowledge to advise end-user customers on the selection and safe use of the Products, as well as any applicable warranty or return policy. Retailer must make itself available to respond to customer questions and concerns both before and after sale of the Products and should endeavor to respond to customer inquiries promptly. Retailer and Retailer’s agents must represent the Products in a professional manner and refrain from any conduct that is or could be detrimental to the reputation of Anatech. Retailer agrees to cooperate fully with Anatech in any investigation or evaluation of such matters.
- ONLINE STORE TERMS
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.
- GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.
Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
- ACCURACY OF BILLING AND ACCOUNT INFORMATION
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly advise of any changes, including address and contact information, as well as credit card numbers and expiration dates if requested.
- DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of this website will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from its use will be accurate or reliable. You agree that from time to time we may need to remove the service for periods of time to upgrade the website without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, are under the warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

- TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use this trade store to purchase product, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
- ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). It is your responsibility to check our website periodically for changes.
